Terms of
Service

Effective August 2026 Governing law California

These terms cover how we work together: what you are buying, what we owe you, what you owe us, and who owns the pictures. Booking a shoot means you agree to them. They are written to be read, not to hide anything.

Agreement

These Terms of Service form an agreement between you and Mosaic Property Solutions LLC, doing business as Mosaic Property Solutions. When you book a shoot, submit a form, pay an invoice, or accept delivery of our work, you agree to these terms.

If you are booking on behalf of a brokerage, team, seller, or property owner, you confirm you have the authority to bind that party to these terms.

What we provide

We provide real estate listing media, which may include photography, video, aerial photography and video, floor plans, virtual tours, virtual staging, and related editing and delivery. The specific deliverables for your booking are the ones listed in the package or services you selected, at the prices published on our rate sheet at the time you booked.

Published square footage limits set which package applies to a property. A property above a tier's limit books the next tier up, or is quoted separately.

Booking and payment

  • Payment in full is due at booking unless we have agreed otherwise in writing.
  • Prices are as published on the rate sheet at the time of booking. We may change published prices at any time, and a change does not affect a shoot already booked and paid.
  • Travel inside our covered areas is included. Outside those areas, mileage bills at the published per mile rate from the nearest covered area.
  • Additional services requested on shoot day are quoted and billed separately.
  • Unpaid invoices may result in delivery being withheld until payment clears.

Rescheduling and cancellation

Reschedule free with more than 24 hours notice. Inside 24 hours, or if we arrive and cannot enter the property, a $40 fee applies and must clear before the shoot is rebooked.

If you cancel entirely with more than 24 hours notice, we refund what you paid less any costs already incurred. Inside 24 hours, the $40 fee is retained and the balance refunded.

If we have to cancel or reschedule, we will tell you as soon as we know and offer the next available window. If we cannot deliver at all, you get a full refund.

Access and readiness

You are responsible for making sure we can get into the property at the scheduled time and that it is ready to be photographed. That includes access instructions or codes provided in advance, lights working, and the property staged or tidied to the condition you want captured.

We are photographers, not a cleaning or staging crew. We will move a small item out of frame as a courtesy. We do not clean, declutter, rearrange furniture, or move anything heavy, valuable, or fragile.

Lockouts If we arrive and cannot enter, cannot reach anyone, or the property is not in a condition that can be photographed, that counts as a same-day cancellation under section 4. We wait 30 minutes before calling it.

Turnaround and delivery

Turnaround times run from the completion of the shoot: The Standard within 24 hours, The Signature within 36 hours, The Prestige within 48 hours. A twilight session is a second visit, so the clock starts when that visit is finished.

Delivery is by online gallery link with downloadable files. Turnaround times are business commitments made in good faith and may extend in the event of equipment failure, illness, severe weather, or circumstances outside our control. We will tell you promptly if a delivery is going to be late.

The Reshoot Guarantee

If the delivered gallery does not meet the standard we set before the shoot, we reshoot the property at no charge. Raise it within 48 hours of delivery and we schedule the return visit.

The guarantee covers our work: framing, exposure, sharpness, color, coverage, and edit quality. It does not cover changes to the property after the shoot, a change of mind about staging or furniture, a request for a different creative direction than what was agreed, or a request for additional services not in the original booking. Those are quoted as a new shoot.

Aerial and airspace

Aerial work is flown by an FAA Part 107 certificated remote pilot in accordance with federal regulations.

  • Most airspace requires LAANC authorization, which can take up to 72 hours. Aerial packages must be booked at least three days in advance.
  • Send us the property address as soon as you book so we can check it. If the property sits in restricted airspace where a flight cannot be authorized, we quote the published non-aerial rate for that package instead.
  • We will not fly where regulations, weather, or safety conditions prohibit it. That decision belongs to the pilot in command and is final.
  • If weather or a late authorization stops a flight on shoot day, we return on the next clear window and shoot the aerial at no additional charge.

Weather

Exterior and aerial reshoots are free when weather calls the shoot. We move you to the next clear window. Interior work generally proceeds regardless of weather.

We make the call on weather with as much notice as we can give. Weather cancellations are not subject to the same-day cancellation fee.

The Partner Plan

  • The Partner Plan is twelve prepaid shoot credits at $400 each, billed as four quarterly payments of $1,200 across the first twelve months, for a total of $4,800.
  • Credits remain valid for the full fourteen month term from the start date. Unused credits expire at the end of the term.
  • Each credit covers one Standard shoot inside a covered market. Upgrade to The Signature for a credit plus $300, or The Prestige for a credit plus $540.
  • Credits may be used ahead of the payment schedule by up to three credits beyond what you have paid to date. A slow month never costs you a credit, and nothing resets until the term ends.
  • Shoots beyond twelve bill at the published rate.
  • Refunds. Prepaid credits are non-refundable. If you end the plan early, we true up: shoots already delivered are re-priced at the published single-shoot rate for the package used, and we refund anything you have paid above that total, or invoice the difference if the re-priced total is higher.
  • Transfers. Credits may be transferred to another agent at the same brokerage with our written approval, at no charge. They may not be resold.
  • If a quarterly payment is more than 30 days past due, the plan ends and the true-up above applies.

Copyright and your license

We retain full copyright in all photographs, video, floor plans, tours, and other work we create. Copyright is not transferred by payment.

On payment in full, we grant you a license to use the delivered media as follows:

  • Marketing the property. Unlimited use to market the specific property photographed, on the MLS, listing portals, social media, print, email, and your website, for as long as you want.
  • Your own branding. Unlimited use for your personal agent branding and portfolio, in perpetuity.
  • Brokerage-wide use. Available on request and quoted separately. The standard license covers the individual agent or team who booked the shoot, not an entire brokerage.

The license does not permit reselling or relicensing the media to a third party, providing it to another photographer or media company as their own work, or using it to market a different property. If the property is relisted later by a different agent, that agent needs their own license from us.

Editing the work Crop and resize freely for platform requirements. Do not apply filters, alter the property's appearance, or composite elements into an image in a way that misrepresents the property, and do not remove any credit or watermark where one is present.

Our use of the work

We may display delivered media in our portfolio, on our website, in social media, in advertising, and in proposals to prospective clients. Where practical we credit the listing agent.

If you need a specific property excluded, tell us in writing before delivery and we will honor it. Sellers with privacy concerns, off-market listings, and high-profile clients are all normal reasons to ask, and we do not require an explanation.

Virtual staging

Virtually staged images are digitally furnished and do not depict the property's actual contents. You are responsible for disclosing virtual staging wherever the images appear, in accordance with your MLS rules, your brokerage policy, and applicable advertising law.

We label virtually staged files on delivery. Removing that label or presenting a staged image as an unaltered photograph is your responsibility and your liability.

What you promise us

By booking, you confirm that:

  • You have the right to authorize photography of the property, or you have obtained that right from the owner.
  • Any access codes or entry methods you give us are ones you are permitted to share.
  • Occupants have been notified that a shoot is happening.
  • Any artwork, signage, or third-party material visible in the property may be photographed, or you will tell us what to exclude.
  • The information you give us about the property is accurate.

Contractors

We work with a vetted network of photographers, pilots, and editors. Some or all of your shoot may be performed by a contractor engaged by us. We remain responsible to you for the quality of the delivered work and for these terms.

No guarantee of outcome

We produce listing media. We do not guarantee that a property will sell, sell faster, sell for more, or generate any particular level of interest. Market conditions, pricing, location, and how a listing is marketed are outside our control and are not part of what you are buying.

Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim arising from a shoot, the media delivered, or these terms is limited to the amount you paid us for that specific booking.

We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost commissions, lost sales, or lost opportunity, even if we were advised such damages were possible.

We are not responsible for damage to a property, its contents, or its occupants except to the extent caused by our own negligence while on site. Report any such issue to us within 48 hours of the shoot.

Nothing in these terms limits liability that cannot be limited under California law.

Indemnification

You agree to defend, indemnify, and hold us harmless from any claim, loss, liability, or expense, including reasonable attorney fees, arising from your use of the delivered media, your breach of these terms, your failure to obtain necessary permission to photograph a property, or your failure to disclose virtual staging.

Chargebacks

If you have a problem with the work, contact us first. The Reshoot Guarantee exists precisely so that a quality issue can be fixed rather than fought over.

Initiating a chargeback on a completed and delivered shoot without first raising the issue with us is a breach of these terms. It suspends your license to use the delivered media until the matter is resolved, and we may recover the disputed amount along with any fees charged to us.

Governing law

These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute will be brought in the state or federal courts located in Sacramento County, California, and both parties consent to that jurisdiction.

If any provision of these terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it.

Changes and contact

We may update these terms as the business changes. The version in effect when you booked is the one that governs your booking. Updates are posted here with a new effective date.
